Extinguishment of Right of Way Order

The Scottish Ministers give notice that they have made the above-mentioned Order, in exercise of the powers conferred on them by section 3 of the Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947, extinguishing a public right of way in the County of Inverness-shire and providing an alternative public right of way, as described in the Schedule hereto.

A copy of the Order and of the relevant plans referred to therein may be inspected, free of charge, from 17 January 2025 to 28 February 2025 during normal business days at the following location:-

  • Transport Scotland, 2nd Floor, 36 North Hanover Street, Glasgow, G1 2AD;
  • Badenoch Library, Badenoch Centre, Spey Street, Kingussie, PH21 1EH;
  • The Highland Council Service Point, The Courthouse, High Street, Kingussie, PH21 1HR; and
  • The Highland Council Service Point, Townhouse, Castle Street, Inverness, IV1 1JJ.

Any person wishing to question the validity of the decision to make the Order, or any of its provisions, may make an application as regards that validity to the Court of Sessions, within such time period as that Court in its discretion will allow.

Part 1 - Public right of way to be extinguished

  1. The public right of way, not being a right of way enjoyable by vehicular traffic, from a point 795 metres or thereby west, south-west of point 1 in a generally northerly direction for a distance of 30 metres or thereby to a point 785 metres or thereby west, south-west of point 1 as shown by black and white hatching between points marked “point A” and “point B” and numbered “1” on the plan.
  2. The public right of way, not being a right of way enjoyable by vehicular traffic, from a point 670 metres or thereby west, south-west of point 1 in a generally north-easterly direction for a distance of 55 metres or thereby to a point 625 metres or thereby west, south-west of point 1 as shown by black and white hatching between points marked “point C” and “point D” and numbered “2” on the plan.
  3. The public right of way, not being a right of way enjoyable by vehicular traffic, from a point 220 metres or thereby west, north-west of point 1 in a generally easterly then south-easterly then north-easterly, then easterly direction for a distance of 120 metres or thereby to a point 130 metres or thereby north-west of point 1 as shown by black and white hatching between points marked “point E” and “point F” and numbered “3” on the plan.

Part 2 - Alternative right of way to be provided

  1. An alternative right of way, not being a right of way enjoyable by vehicular traffic, will be provided from a point 795 metres or thereby west, south-west of point 1 in a generally east, north-easterly direction for a distance of 770 metres or thereby to a point 105 metres or thereby north-west of point 1 as shown by stipple between points marked “point G” and “point H” and numbered “4” on the plan.
  2. An alternative right of way, not being a right of way enjoyable by vehicular traffic, will be provided from a point 130 metres or thereby north-west of point 1 in a generally north-westerly then west, south-westerly direction for a distance of 110 metres or thereby to a point 225 metres or thereby north-west of point 1 as shown by stipple between points marked “point I” and “point J” and numbered “5” on the plan.
