The A835 Trunk Road (Loch Garve) (Temporary Prohibition on Use of Road and Temporary 30mph Speed Restriction) Order 2025
The Scottish Ministers give notice that they have made the above Order under sections 2(1) and 2, 4(1) and 14(1)(b) and (4) of the Road Traffic Regulation Act 1984, Speed Restrictions on that length of the A835/A893 Tore – Ullapool Trunk Road, from a point 3.5 kilometres or thereby southeast of Garve in a south-eastwards direction for a distance of 700 metres or thereby.
The Order is required to facilitate temporary speed restrictions on the A835 Trunk Road to accommodate a lane closure in order to repair a safety barrier will be in place from 3 February 2025 until 1 September 2025. Restrictions on the trunk road will be in operation between 24 hours a day as indicated by the appropriate traffic signs.
The Order does not apply to vehicles while being used in an emergency for fire service, coastguard, ambulance or police purposes or to acts done with the permission or upon the direction of a police constable in uniform, or a vehicle being used for carrying out the works.

Statement of Compatibility
In accordance with section 23(2) of the United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 (the Act), the Scottish Ministers certify that, in their view, the A835 Loch Garve (Temporary 30mph Speed Restriction) Order 2025 is compatible with the UNCRC requirements as defined by section 1(2) of the Act.

Name the proposal, and describe its overall aims and intended purpose.
The A835 Trunk Road (Loch Garve) (Temporary Prohibition on Use of Road and Temporary 30mph Speed Restriction) Order 2025. This order temporarily reduces the speed limitation from national speed limit to 30 mph on the length of the road described in the schedule of the order between 3 February 2025 to 13 February 2026. The Order is required to facilitate temporary speed restrictions on this section of A835 Trunk Road and a lane closure following road traffic collision to the safety barrier. The safety barrier was supported on top of an old retaining wall that has now become unstable to provide sufficient support to the trunk road. The lane closure with speed restrictions would assist to safely manage the traffic and risk to road users until permanent repairs are undertaken.

2. With reference given to the requirements of the UNCRC (Incorporation) (Scotland) Act 2024 (Annex 1), which aspects of the proposal are relevant to/impact upon children’s rights?
During the temporary speed restriction of this section of road there will be no impact on children and young people’s ability to access:
- school
- childcare facilities
- higher or further education institutions
- hospitals
- places used for recreational activity
- places of worship
As none of these facilities affected by the restrictions of the order on this area of road. Therefore, this order will not impact articles 14, 24, 28 or 31. Therefore we do not see any potentially negative impacts to children and young people as a result of this order.
3. Please provide a summary of the evidence gathered which will be used to inform your decision-making and the content of the proposal
The operating company responsible for the roadworks have past experience and knowledge to support our decision making process, however, engagement, consultation and communication are extremely important in our planning and delivery of works. As part of this process, maps are used to determine who will be impacted within a certain mile radius.
The company has mapped out the extents of this order and we are aware of the impact to the travelling public (particularly with this being the strategic trunk road network), and where road closures are required, have suitable diversions in place. Utilising maps, sites are identified, such as schools, which may be impacted by the roadworks. This assessment includes buildings next to the trunk road, which generally is not the case on this network, as well as buildings nearby which may be impacted by works on the trunk road, or facilities within a diversion route.
Utilising mapping tools, the operating company can identify buildings such as schools and hospitals which could possess a risk. Once impacted stakeholders are identified (schools, hospitals etc), contact is made to discuss the impact works will have on each individual stakeholder. The works go through stakeholder consultation in advance of them being carried out, including liaison with local authorities and Police Scotland, and feedback is obtained on any required adjustments to the traffic management or work proposals. There have been no comments received in relation to this Order.

As the A835 Trunk Road is kept open at all times with speed restrictions there is no impact to children’s rights and wellbeing throughout the duration of this order however due regard will be given as to the development of any permanent repair which has the potential to impact children and young people.
