Extinguishment of Right of Way Order
The Scottish Ministers give notice that they have made the above-mentioned Order, in exercise of the powers conferred on them by section 3 of the Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947, extinguishing public rights of way in the County of Inverness-shire and providing alternative public rights of way, as described in the Schedule hereto.
The Order comes into operation on 6 December 2024.
A copy of the Order and of the plan referred to therein may be inspected, free of charge, from 6 December 2024 to 17 January 2025 during normal opening hours at the following locations:-

Any person wishing to question the validity of the decision to make the Order, or any of its provisions, may make an application as regards that validity to the Court of Session, within such time period as the Court in its discretion will allow.

Part 1
Public right of way to be extinguished
- A length of the existing public right of way, not being a vehicular right of way, heading in a generally north, north-easterly, direction from the quarry access east of Lynwilg Gardeners Cottage and west of the M9/A9 Trunk Road, leading to Grampain Road, Aviemore, Inverness-shire.
- A length of the existing public right of way, not being a vehicular right of way, leading from Balnabruich Cottage, in a generally east, south-easterly direction across the existing M9/A9 Trunk Road, Inverness-shire.
- A length of the existing public right of way, not being a vehicular right of way, heading in a generally north-easterly direction from the track at Slochd Summit across the existing M9/A9 Trunk Road towards the Highland Railway Line, Inverness-shire.
Part 2
Alternative right of way to be provided
- A public right of way heading in a generally north, north-easterly direction from the quarry access road east of Lynwilg Gardeners Cottage and west of the M9/A9 Trunk Road, leading to Grampian Road, Aviemore.
- A public right of way from Balnabruich Cottage where the existing right is being extinguished heading in a generally east, north-easterly, then north, north-easterly, then westerly direction, alongside the east side of the M9/A9 Trunk Road, then crossing under the M9/A9 Trunk Road, then alongside the west of the M9/A9 Trunk Road.
- A public right of way heading in a generally north-westerly, then north-easterly, then south-easterly, direction alongside the north-east side of the A9 Trunk Road, then crossing under the M9/A9 Trunk Road, then alongside the south-west side of the M9/A9 Trunk Road at Slochd Summit.
